Taylors’ Intellectual Property
client Winer Diner Limited has successfully protected it’s
registered designs on the Winer Diner Picnic Table by the threat of
proceedings against the importers of a “lookalike” table, Eden
Contract Furniture.
Tony Catterall's
IP Litigation Team secured an agreed settlement whereby Eden
Contract Furniture undertook not to infringe any of Winer Diner’s
registered designs, to remove the Eden table from sale immediately
and to destroy all residual stock.
Eden also agreed to pay damages and a substantial costs contribution
to Winer Diner.

Tony
Catterall said: “The Winer Diner table is a distinctive
product that is well known in the market place and is protected by
registered designs.”
“This successful claim again Eden Contract Furniture illustrates
that we have the speed of reaction and ability to put pressure on
our client’s opponents quickly to secure a favourable settlement
without incurring the financial and management time cost of
long-running litigation” confirmed Tony.
